Member collected unemployment benefits in 2008. Member received letters stating that he owed an overpayment of benefits to him in the amount of $2,000.00. Employment Security Department then issued a warrant to collect the money. Member stated that he was too late for an appeal. Provider attorney advised member to draft an appeal anyway. Based on the facts, it appeared that member had a reasonable argument that the overpayment should be waived because the overpayment was not his fault. Provider attorney went over member's facts and helped him to draft the appeal. Member called to say that the warrant for the overpayment had been vacated in court by the Department of Employment Security.
Member's indoor skateboard park received notice from BMI music licensing company demanding $5000 for an annual license. Member denied playing any music in his facility, and asserted that his clients only use personal listening devices. Attorney called BMI and they agreed that member owes no licensing fee under these facts. Savings are $5000 per year times the number of years member will be in business.
